Once a driver is suspected of being under the influence of alcohol or drugs, the arresting officer will not allow him or her to drive the vehicle, even if it is just to move the vehicle to a safe parking place. The driver would be able to retrieve the vehicle when he or she is released from custody and would likely have to pay expensive impound and tow fees. In there is a licensed passenger in the vehicle who is not under the influence, the officer may allow the passenger to drive the vehicle after the driver has been arrested and taken into police custody.
In other cases, if the vehicle is parked in a safe and legal location, the officer may decide not to tow the vehicle and may allow the driver to retrieve the vehicle once he or she has been released from custody. In some cases involving DUI accidents or fatalities, the police may determine that the vehicle is evidence in the case and may order the vehicle to be held at the police impoundment lot.
